Guarantee

Section I

Stolpaw, acting as manufacturer (and as Guarantor in this Guarantee Card) provides a guarantee for its products in the area of Poland providing they have been mounted and used according to their intended purpose in compliance with the Instructions of Product Assembly, Use, and Maintenance incorporated in this Guarantee Card.

Section II

This guarantee shall apply for 24 months from a confirmed date on a proof of purchase (invoice, receipt). The guarantee shall be extended with the time needed to repair an element (product) subject to a complaint, calculated from the date of reporting such complaint to the date of repair. Such period should be confirmed in the Guarantee Card.

Section III

All complaints shall be reported in writing at the location of purchase, presented with a correctly filled Guarantee Card, Product Card and a proof of purchase (invoice, receipt). The Guarantee Card and Product Card are attached to each product, and it is the Buyer's responsibility to collect them (from a Seller) and keep them for the guarantee period. Should the Guarantee Card be lost, a new one shall not be issued.

Section IV

The Guarantor shall consider and settle complaints in consultation with the Buyer as soon as possible but not later than 14 days after receiving a claim report. Should any steps (inspection, repair, replacement) be prevented by default of the Buyer, the situation shall not be treated as delay in handling of such complaint.

Section V

Within the guarantee period, the Guarantor shall repair a product free of charge should latent defects be discovered at the time of use.

Section VI

The Guarantor shall also replace a product with a faultless product in the following cases:

  • should manufacturing faults of the product prevent its repair
  • should three consecutive repairs prove ineffective

Section VII

The Guarantor shall have the right to finally qualify any discovered latent defects and to determine methods of their repair. Should a defective product be replaced with a new one, the Buyer shall return such defective product on receipt of a defect-free product.

Section VIII

Should the nature of discovered defects not require repair in the plant, such repair will be undertaken at the Buyer's. Should the product require repair in the plant, however, the Guarantor shall mount a replacement door at the Buyer’s location to allow for locking and normal use of a house (flat) (applicable to complaints about outside doors).

Section IX

Complaints regarding clear defects (quality faults) shall only be considered if reported prior to mounting, where mounting operations are discontinued. Mounting of additional furnishings shall be treated as the start of assembly operations. Commencement of the product assembly shall be tantamount to the Buyer accepting a given clear defect (quality fault), and any claims thereunder shall not be considered by the Guarantor..

Section X

The Guarantor shall not be liable for damage to or destruction of a product for causes other than its inherent defects. In particular, it shall not be liable for:

  • mechanical damage and resultant defects
  • mechanical damage not found at the time of receipt that may arise as a result of inappropriate transportation, storage, assembly or use (including damage caused by pets), and operation not in accordance with the intended use of a product
  • incorrect assembly
  • defects caused by the Buyer negligence or ignorance
  • defects caused by inappropriate protection of products at the time of building work (improper cleaning agents, exposure to such chemical agents as: plaster, gypsum, mortar, paints and lacquers, etc.)
  • products used in rooms exposed to humidity
  • defects caused by cleaning with large-grain or aggressive chemical agents
  • actions to be undertaken by the Buyer at their own expense, such as regular maintenance and adjustment
  • slight variations of shade and colour intensity across the door elements coated with transparent paints, characteristic for natural wood products (including characteristically slight uneven annual (early and late) growths
  • natural wear and tear of products, including natural colour changes over time
  • defective operation of the product caused by damage due to random conditions of use beyond control of the Guarantor (fire, flood, burglary, etc.)

Section XI

Rights hereunder shall be forfeited in case of:

  • willful remakes or interventions into the product design (shortening, planning, fitting of additional furniture, etc.), both in wings and frames
  • lack (loss) of any of the documents: Guarantee Card, Product Card, proof of purchase
  • the Guarantee Card lacking the date of purchase, seller's stamp and signature, or any corrections by unauthorised parties

Section XII

Should unreasonable complaints be reported, the Guarantor shall have the right to charge the Buyer with any costs of processing such complaints.

Section XIII

Any damage caused by inappropriate storage, operation, assembly, maintenance or any other reasons beyond control of the Guarantor may only be repaired at the Buyer's expense.

Section XIV

Executing a purchase and acceptance of a Guarantee Card shall mean the Buyer has accepted terms and conditions of this guarantee.

Section XV

Civil Code provisions shall apply to matters not governed hereunder.

Section XVI

This guarantee shall not exclude, limit or suspend the Buyer's rights where the product fails to conform with a contract.
